Terms and Conditions

1. DEFINITIONS

Organizer – Rico Canarias (Piotr Mikulski, C. Punta Pesebre 4/30, Costa Calma, NIF: Y4228053T, e-mail: info@rico-canarias.pl). Rico Canarias organizes the following travel services: excursion Fuerteventura Deluxe, Lanzarote Premium.

Intermediary – an entrepreneur who, at the Customer’s request and on his behalf, concludes a contract with an operator or other service provider. The intermediary is not responsible for the quality of the service provided by the mentioned entrepreneurs, his liability is limited.

Customer – a person making the reservation and paying the tourist service payment to Rico Canarias. He/she is responsible for the payment of the total amount of the service for all persons mentioned in the booking (participants). He/she is also required to inform participants of all details regarding the service.

Excursion – a trip offered by the Operator for customers staying in the Canary Islands. Tours do not last longer than 24 hours and do not include accommodation.

Agreement – an agreement for participation in the excursion concluded by the Organizer with the Customer concluding it on his/her own behalf or on behalf of third parties who authorized him/her to conclude this Agreement.

2. TERMS AND CONDITIONS

These Terms and Conditions define the rules of participation in Optional Trips organized by Rico Canarias.

Participation in the Tour takes place only on the basis of a valid Agreement, of which

the Terms and Conditions are an integral part.

The Terms and Conditions are accepted as follows:

  • acceptance of the Terms and Conditions on the Organizer’s website (www.rico-canarias.com).
  • In the case of concluding the Agreement directly with a representative of Rico Canarias – at the time of its conclusion, by signing a declaration that you have read and accepted the Terms and Conditions.

3. BOOKINGS AND PAYMENT

A Customer can make a booking by:

  • completing the appropriate form on the Rico Canarias website
  • direct contact with a representative of Rico Canarias

When making a booking, the Customer is obliged to read the Terms and Conditions and accept them.

When making a booking, the Customer agrees to the processing of personal data (and personal data of Participants) in the scope of name and surname, telephone number, e-mail address, and place of accommodation. When booking an excursion to Lanzarote, the date of birth is also required. The administrator of personal data is the Organizer. Providing personal data is voluntary but necessary in the booking process. The Customer has the right to access their personal data and correct them.

After receiving the data needed to make a booking, the Organizer may reserve the places for the tour indicated by the Customer, provided that the remaining number of vacancies in the Tour Date selected by the Customer is sufficient. The Organizer notifies the Customer about the lack of vacancies by e-mail, by phone, or in person.

The payment of the trip price is tantamount to the conclusion of the contract.

Rico Canarias reserves the right to cancel the booking without giving any reason. In this case, the customer will be informed no later than the day before the departure and will receive a full refund of the amount paid.

The Customer has the right to cancel the booking or withdraw from the Agreement without incurring any fees if he informs the Organizer no later than 48 hours before the scheduled collection time. If the cancellation is made for less than 48 hours, the costs are not refunded.

The Customer can postpone the purchased service at no cost. In this case, he/she is obliged to inform Rico Canarias no later than 48 hours before the scheduled collection time, by sending a request to info@rico-canarias.com. If it is possible due to the number of available places, schedule, etc., Rico Canarias will change the date of booking at no additional cost.

When the customer pays the entire amount for the tourist service, and its implementation is not completed due to the Customer’s fault, the amount paid is not refunded. The Customer’s fault is:

  • failure to arrive on time at the assembly point. The customer is required to wait 10 minutes before the scheduled time at the meeting point for the bus. Due to the need to implement the program on time, Rico Canarias is not obliged to wait for a late customer.
  • state of intoxication or use of other intoxicants preventing the performance of the contract. People who behave aggressively and pose a threat to the efficient organization of the trip may also be excluded from the trip.

Rico Canarias reserves the right to immediately terminate and withdraw from the contract with the Customer in the above-mentioned cases. In this situation, Rico Canarias is no longer responsible for the Customer until the end of the tourist service and will not ensure his return to the meeting point.

4. USE OF IMAGE

By accepting the Terms and Conditions, the Customer agrees to the free use of the image recorded during the performance of the contract for marketing purposes (folders, leaflets, website, etc.)

5. OTHER PROVISIONS

By accepting these Conditions, the Customer declares that his health condition allows him to use the selected service. People suffering from chronic diseases should take out additional insurance on their own. Otherwise, the Customer takes part in the excursion at his own risk.

Rico Canarias is not responsible for the luggage and personal belongings of the Customer left in the means of transport or on the route of the excursion.

The use of a mask is compulsory during all excursions.

The Regulations enter into force on July 30, 2020, and apply to Agreements concluded from July 30, 2020, inclusive.

6.COMPLAINTS

Any reservations should be reported immediately to the tour conductor during the excursion.

In the event of dissatisfaction with the quality of services provided by the Organizer as part of excursion, the Customer has the right to file a complaint.

Complaints should be sent to info@rico-canarias.com no later than 30 days after the end of the excursion. In the event of dissatisfaction with the resolution of the complaint, the Customer may assert his rights in court.

The trip is organized on the territory of Spain, therefore in matters not covered by these Regulations, the provisions of Spanish law shall apply, in accordance with art. 6 sec. 3 and 4 in connection with from Art. 1 of the Regulation of the European Parliament and of the Council (EC) No. 593/2008 of 17 June 2008 on the law applicable to contractual obligations (Rome I), OJ L 177, 4.7.2008, p. 6.
